1. Right of Withdrawal

Consumers who are entitled to a statutory right of withdrawal under the applicable distance-selling rules have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which:

  • in the case of a single delivery, you or a third party designated by you, other than the carrier, takes possession of the goods;

  • in the case of several goods ordered in one order and delivered separately, you or a third party designated by you, other than the carrier, takes possession of the last item; or

  • in the case of goods delivered in several lots or pieces, you or a third party designated by you, other than the carrier, takes possession of the last lot or piece.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement, for example by letter or email.

You may use the model withdrawal form provided below, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice exercising the right of withdrawal before the withdrawal period expires.

2. Effects of Withdrawal and Refund

If you validly withdraw from the contract, we will refund all payments received from you, including the cost of the standard delivery method offered by us.

Additional delivery costs resulting from your choice of a more expensive delivery method than our least expensive standard delivery method will not be refunded.

Refunds will be made without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the refund.

We may withhold the refund until:

  • we have received the goods back; or

  • you have provided evidence that you have returned the goods,

whichever occurs first.

This right to withhold the refund does not apply where we have offered to collect the goods ourselves.

3. Returning the Goods

You must return the goods without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal.

The deadline is met if you send the goods before the 14-day period expires.

Please do not return goods to the registered office in Ferlach unless we specifically instruct you to do so.

4. Return Costs

You bear the direct cost of returning the goods.

For goods which, because of their nature, cannot normally be returned by post, the estimated maximum return cost is:

  • EUR 75 for returns from Austria and Germany;

  • EUR 250 for returns from other countries.

Where different maximum amounts apply depending on the country of return, the applicable country-specific amount must be stated in the corresponding return information before the order is placed.

If MARO GmbH agrees to arrange collection of the goods for you, the agreed collection cost may be deducted from the amount refunded to you.

5. Loss of Value

You are only liable for any reduction in the value of the goods resulting from handling which goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Important information concerning shower toilets and bidet seats

Once a shower toilet, electronic bidet seat or similar product has been installed, connected to the water supply and used, such use will generally go beyond what is necessary merely to establish the nature, characteristics and functioning of the goods.

Such installation, connection or use may therefore result in a reduction in value for which you may be liable.

This does not automatically exclude the statutory right of withdrawal.

6. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply, in particular, to contracts concerning:

  • goods made to the consumer’s specifications or clearly personalised;

  • sealed goods which are not suitable for return for reasons of health protection or hygiene, where the seal has been removed after delivery;

  • goods which, after delivery, have become inseparably mixed with other goods due to their nature; or

  • services which have been fully performed, where performance began with the consumer’s prior express consent and acknowledgement that the right of withdrawal would be lost once the contract had been fully performed.

Hygiene seals

Where a product is supplied with a qualifying hygiene seal, please do not remove the seal merely to check whether the product is suitable for your toilet.

Where possible, dimensions and compatibility should be checked before installation or removal of any hygiene seal.

The statutory exception for sealed hygiene goods applies only where the legal requirements for that exception are satisfied.

7. General Return Information

Where reasonably possible, please return the goods with all supplied accessories, manuals and other components.

Please package returned goods adequately to protect them against damage during transport.

Use of the original packaging is recommended where available, but is not a condition for exercising the statutory right of withdrawal.

Please do not send goods freight collect unless this has been agreed with us in advance.

These recommendations do not affect your statutory right of withdrawal.
